Abstract:
The system of teacher appointment is the core of reform of personnel administration in higher learning institutions, while the teacher's legitimate identity is the theoretical basis of constructing and realizing this system. However, the affirmation of the teacher's legitimate identity in the system of teacher appointment by the operating statutes of our country is either obscure or contradictory. Theoretically, teachers should be identified as workers, who are legally related to schools by working contract based on equality and willingness. The teacher's right and obligation in teaching should be clearly claimed, which will make active effects on protection of legal right and interests. Therefore, to complete the system of teacher appointment, the teacher's legitimate identity as a worker should be established so as to set up a set of systems based on the working contract for protection of the teacher's legal right and interests.
