Abstract:
The writ of execution is the most important statutory procedure in the American enforcement system, and it is also the primary means and approach to enforce the money judgment, with all the other procedures serving as its subsidiary and supplementary procedures. On the basis of relevant statutes of respective state, the writ execution procedure enforces the implementation of the judgment by performing the levy and sale of the properties. Though limited by its inherent restraints, this procedure provides tremendous reference for us to leverage on to study and establish our judgment enforcement law on the aspects of commencement timings of the application, standardization and specialization of the enforcement supervision and the protection of stakeholders’ interest.
