Abstract:
The relationship between judicature and moral is the core concern of Cardozo’s Character of Judicial Proceedings. In the book Cardozo mainly explores the connection between judicature and moral, the way to actualize a combination of the two, the legal consistency and definiteness to be maintained after the combination and like, which reveals rich and elaborate new ideas and enlightenment. This makes us think over current hot and distinct issues, such as copying with the relationship between judicial professionalism and sociality and between judicature and moral assuring some flexibility under legal consistency and definiteness so as to realize the harmonious cohesion between professional requirements and fine social effects. Moreover, we should treat properly our nation’s tradition of fusion of propriety and law and convert it into distinctive advantages and functions of our legal culture.
